Loyalty Rewards - Program Terms (U.S.)

The Lew’s Loyalty Rewards Program (the "Program") is brought to you by Rather Outdoors Corp. ("we"). Participation in the Program is subject to these terms and conditions, the general Terms of Use, and Privacy Policy which are incorporated herein (collectively, the "Program Terms"). The benefits and rewards are provided in connection with purchases made while logged into your lews.com account (“Lew’s Account”).

Eligibility

In order to participate as a Program Member (defined below) in the Program you must reside in the United States, and be 18 years of age or older with a Lew’s Account in good standing. You may only have one Program account ("Program Account") and may not share memberships or have multiple memberships. However, there may be more than one Program Member in a household. Memberships cannot be merged or transferred. By participating in this Program, you are agreeing to these Program Terms. If you do not agree to these Program Terms, do not participate in the Program. All participants in the Program are "Program Members."  A lews.com user may sign up for the Program at www.Lews.com. By signing up for a Lew’s Account, a lews.com user becomes a Program Member. 

Joining Loyalty Rewards

There are two (2) ways to join Loyalty Rewards and begin accumulating Points: 

1. If you currently have a Lew’s Account, you will automatically be enrolled into the Program, subject to these Program Terms.

2. If you currently do not have a Lew’s Account, you may enroll into the Program by creating a Lew’s Account. To create a Lew’s Account, visit; www.Lews.com/en/register/ and select “create account.” Fill out the required form and select “Register.”

To be eligible to participate in the Program in accordance with these Program Terms, purchases from your Lew’s Account must be shipped to a physical address in the United States (excluding Puerto Rico) or the US Virgin Islands.

How to Earn Points

The Program includes one type of rewards point (a “Reward Point” or “Point”). Reward Points are redeemable at certain thresholds for a discount on a lews.com purchase. Points have no cash value. Points are earned at the time an eligible lews.com transaction is processed by Lew's against your payment method.

Points may only be earned on dollars spent before taxes and shipping fees on your total order price. Points are not awarded when using gift cards.

Bonus Points

From time to time, Lew's, or others acting with our permission, may offer you opportunities to earn additional "Bonus Rewards Points" through special promotions. Such as account set up, email sign up, refer a friend, etc. These promotional Bonus Rewards Points will be awarded as described in the applicable promotional offer and will be subject to any additional terms set forth in such promotional offer.

Exclusions to Earning Rewards Points

The following Lew's orders are not eligible to earn Rewards Points in the Program:

• Purchases made outside of Lews.com
• Orders placed on clearance items
• Orders outside of the United States and U.S. Virgin Islands

Refunds or Order Cancellation

Points may be revoked when an order, for which Points were earned, is refunded. If you cancel or are refunded a purchase made on lews.com through your Lew’s Account, Lew's will deduct the Points that you earned for that purchase, potentially resulting in a negative Points balance on your Loyalty Rewards account. Points may be revoked where Lew's believes in its discretion that Points were earned through or in connection with any fraud, abuse of the platform, duplication of accounts, or violation of Lew's Terms of Use.

How To Redeem Reward Points

When a minimum of 100 Reward Points have been accrued by a Program Member, those 100 Reward Points may become convertible to $10 in Rewards and redeemed on eligible lews.com purchases placed at checkout. Rewards Points convert to the following tiers of Rewards.

You may redeem Rewards Points for Rewards using the Loyalty Rewards Dropdown at checkout:

1. Select the Rewards Dropdown at checkout and select desired redemption tier

2. Click “Apply” to exchange your points for a Rewards discount code

3. The Rewards discount code will be automatically applied to your order

4. If you do not complete your order and would like to use your  Rewards discount code at another time, you can find the coupon by logging into your account and click "Loyalty Center".

You may not redeem Rewards on recurring subscription orders.  Redemption of Rewards may be subject to additional terms and conditions, such as restrictions on use. The number of Reward Points required to redeem Rewards may be changed by Lew's at any time. Once Reward Points are redeemed for Rewards, they cannot be returned to your Program Account.

Program Benefits

Benefits for Program Members are privileges granted to Program Members ("Program Benefits"). There are no participation or membership fees associated with Loyalty Rewards. Program Benefits are granted at the discretion of Lew's, may change at any time, are not redeemable for cash, and have no cash value. Program Benefits, once obtained, can only be utilized in the United States.

How To View Points Balances

Program Members can view their current Points balances, rewards, and benefits within their Lew’s Account, located at Lews.com/account. If you think your Points balance is incorrect, you must report your issue by contacting lews.com within thirty (30) days of any changes to your points balance. If Lew's agrees that a correction is needed, it may take up to four weeks. Failure to supply necessary documentation may result in an inability to award Points. For verification, you should retain all receipts and documentation until your Rewards Points are credited to your Lew’s Account.

Point Expiration

Reward Points are non-transferrable and expire (if not redeemed for a Reward) after twenty-four (24) months of inactivity. Inactivity means a failure by a Program Member to redeem or earn Reward Points for a consecutive twelve (12) month period. For example, if a Program Member earned Reward Points the month of January of 2021 but failed to further earn Reward Points or redeem Rewards Points for Rewards for twenty-four (24) months, those January of 2021 Rewards Points will expire on February 1, 2023. 

Account Termination

Participation in the Program is a privilege granted to Program Members, and as such can be suspended, revoked, or terminated at any time by us for any reason. If your Program membership is terminated, all Points associated with your Program membership and any Program Benefits will be forfeited immediately upon termination. If your Program membership is terminated due to fraudulent activity or noncompliance with these Program Terms, in addition to forfeiting all Points and Program Benefits associated with your Program membership immediately, you cannot participate in or rejoin the Program.

Program Changes and Termination

We reserve the right to change or terminate the Program, or any part thereof, at any time without notice and without further obligations to Program Members, including, but not limited to modifications which:
a) govern how Points are earned on and after the date of change; or b) change the value of rewards. No Points will be earned or redeemed after the effective date of termination. Any and all changes and/or amendments to these Program Terms will become binding upon all members immediately.

Personal Use

The Program is intended for personal use only. Commercial use is prohibited. The Program is not targeted towards, nor intended for use by, anyone under the age of 18. Lew's Privacy Policy is incorporated into these Program Terms and also governs your participation in the Program. Please read the Privacy Policy carefully to understand how Lew's collects, uses and discloses information about customers, how to update or change your personal information, and how we communicate with you.

Transfer of Rights

Lew's rights and obligations under the Program may be assigned or transferred by Lew's to any other related or unrelated entity at any time, and performances shall be the responsibility of that entity.

Interpretation of Program Terms

All interpretations of these Program Terms will be at Lew's sole discretion and Lew's decisions will be final.

Governing Law

Any dispute arising from these Program Terms or your access to or participation in Loyalty Rewards will be governed by and construed and enforced in accordance with the laws of South Carolina, without regard to conflict of law rules or principles. The United Nations Convention on Contracts for the International Sale of Goods shall have no applicability. Any dispute between the parties that is not subject to arbitration or cannot be heard in small claims court will be resolved in the state or federal courts located in Richland County, South Carolina.

The Program and/or any of its features may be unavailable, inaccurate, or interrupted from time to time for a variety of reasons. We are not responsible for any unavailability, interruptions, or errors of the Program or its features. Lew's is not responsible for unauthorized use of Rewards Points. If your Lew's account is closed, you will lose all Rewards Points. Lew's may from time to time request information from you to confirm your identity before it will allow use of your Rewards Points. Lew's may delay your access to the Rewards Points until you comply with this information request. The Program and all the information accessible through it are provided for information purposes only on an "as is" and "as available" basis. We, our information providers and their agents make no warranties, representations, or guarantees of any Lew’s , express or implied, including but not limited to, accuracy, currency, or completeness, the operation of the Program, the information, materials, content, availability, and products. All benefits and rewards made available under the Program, if any, are provided by Lew's and do not modify the contractual relationships among or between Program Members, the individuals and entities that purchase Lew's products to offer goods or services, and Lew's or any Lew's affiliates, except as expressly set forth herein. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose.
